Yeah, this is time for a cease and desist letter.

One question to Ian's last comment: the offensive site is situated in Britain, right? Does the SB:s legal copyrights extend to British copyright laws, since, if I understand it, SB is subject to US fair agreement use and copyright laws? I don't know if this issue would be muddled or whether the EU and the US have some sort of mutual extention to their respective media/copyright laws to cover this kind of conflict either side of the pond.
I know there are differences; just don't know what kind of and to what large degree. I guess what I'm trying to explain is that it may not be as simple as to 'throw the law' in this website's 'face', especially if its servers are located somewhere outside the US; i e the sphere of US jurisdiction, which they probably are. Then they are subject to the host country's particular laws, or may benefit from the absence of such!
Is anyone considering this?

The Berne Convention covers legal situations in the majority of the world.

It provides for reciprocity, and the SbFU is very similar to the Creative Commons License which is written to cover both US and UK laws.

Now this is frustrating: I can't find the fair use agreement, can anyone help?

Very good! Thank you for that clarification, Tim! Then I agree: we should take action.

Thanks Tim :)

No wonder I couldn't find it, its on the old forum. I'll send this to this Jack person, and explain our policy.

This is another finger in the dyke situation; also, you have to register to view their forum, and I couldn't be bothered. I would suggest that with the number of infringements it would a full time job for anyone chasing these; I've emailed Jack the Lad with the fair use and a general outline of our rights; but where does it end? :(

That's from "The Last War". I may not post on HPCA any more, but I am still friends with Jan (or "Bernard" as he goes by now), and I'll talk to him about that.

This is actually one of the reasons why part of me supported SOPA/PIPA - we could have shut down EVERYONE who violated the agreement.
